The Port Huron Police Department would like to remind residents that may be inclined to use fireworks during the upcoming Labor Day holiday of recent changes to the law. City ordinance 34-333 has recently been changed to reflect changes allowed by State legislation. Consumer fireworks use is only permitted the day before, the day of and the day after a national holiday. In addition, during those nationally recognized holidays they may not be used from 1:00am-8:00am. Firework use must be on private property with the express permission of the property owner. A person who owns or is in charge of property who knowingly allows consumer fireworks to be used in violation of this ordinance can also be cited. Violation of this ordinance is a civil infraction punishable by a fine of up to $500. A person using consumer fireworks while under the influence of alcohol or a controlled substance is guilty of a misdemeanor punishable by up to 30 days in jail or a fine up to $500.
