Circuit Court To Review Case

Circuit Judge Cynthia Lane or retired Judge Peter Deegan have been asked by Chief Circuit Judge Daniel Kelly to review new evidence discovered in a rape case that saw James Grissom tried and convicted in 2003.  Prosecutor Mike Wendling filed a motion requesting the case to be reviewed in response to an opinion sent down by the state Supreme Court July 31.  Supreme Court justices say the trial court needs to review the case to determine if evidence discovered after the 2003 conviction would have affected the verdict.  It was discovered after the trial, the victim had made other sexual assault allegations in the months following the attack but before she had reported the attack to police.  The woman states she was raped in May of 2001, but didn’t report the crime until June 2002.  The court must decide if the new evidence warrants a new trial. The court has to make a determination within 60 days of the supreme court opinion being issued.
